March 7, 2008 - Rodolfo Hernandez, 51, a school bus driver, was arrested Thursday on charges of sexually abusing a 3-year-old girl.
According to the source, the victim's mother was tipped off to the alleged crime when the girl came home crying, behaved strangely and her mother saw her underwear disheveled. When asked what happened by her mother, the victim simply answered, "The man," the source said. Pressed by her mother as to what "the man" did, the girl made a gyrating motion with her tongue.Hernandez is charged with criminal sex act in the first degree, sex abuse in the first degree and endangering the welfare of a child in the first degree, police said.
Eventually, the girl revealed more details and investigators took a DNA vaginal swab. When that failed to produce results, they submitted a sample of saliva found on her underpants.Hernandez recently consented to a DNA swab and a match to the saliva found on the underpants was made Wednesday, the source said.
Hernandez is charged with criminal sex act in the first degree, sex abuse in the first degree and endangering the welfare of a child in the first degree, police said.
