CHARGES DISMISSED

Apr 20, 2007 - April T. Robertson, 32, a teacher's aide at Sobesky Academy, a special-education school, was arrested on suspicion of sexually assaulting a 15-year-old male student.

She was arrested for investigation of several felony charges including sexual assault on a child by a person in a position of trust”, sexual assault on a child by a person in a position of trust with a pattern and enticement of a child.

CHARGES DISMISSED September 25, 2008 - Charges of sex assault of a child by a person in a position of trust, and enticement of a child, against April T. Robertson were dismissed in June, according to court records. The case is closed, court records state.
Robertson no longer works for the school district.

Culpeper, VIRGINIA

GRAND JURY DISMISSED CHARGE

June 3, 2008 - Michele Auville, 35, a a first-grade teacher at Emerald Hill Elementary School, was arrested and charged with alleged possession of a schedule 1 or 2 drug May 31 after they pulled over a car she was riding in.

She was a passenger in a car that tried to elude police, according to the Culpeper County Sheriff’s Office. Deputies discovered that Auville had a smoking device with crack residue. The driver of the car fled on foot but was captured.

June 4 - Auville resigned on Monday.

June 11 - Auville’s case will return to General District Court July 17 at 9:30 a.m.

GRAND JURY DISMISSES CHARGE August 20 - A grand jury on Monday dismissed a felony drug charge against Auville.

The circumstances behind the grand jury’s decision will not be disclosed, as all testimony in such proceedings is secret. Court records, however, indicate that prosecutors were unable to definitively link the pipe to Auville.

According to a Certificate of Analysis from the Department of Forensic Science, Auville’s fingerprints were not found on the pipe, which police say was in her vicinity when she got out of the car. And based on a blood test, a separate report indicates that Auville did not have any illegal drugs in her system, A third report however, confirmed that the residue present in the pipe was cocaine.
During the July hearing, the judge rejected a motion from Auville’s defense attorney to strike the case. Smith had argued that because several people were in the vicinity of where the pipe was found, proving possession would be difficult.

August 19, 2008 - Molestation charges were dropped against a Potter Valley math and science teacher. He had been charged with seven counts of annoying or molesting a child and three counts of sexual battery.

Two or three students said he had touched them during the course of class activities when other students were present, [Mendocino County District Attorney Meredith] Lintott said.

The accusations included that Holbrook's hand grazed a girl's breast as he examined her necklace, she said. There were no allegations of any attempt to have sexual relations with the students, she said.

She said the allegations would have been difficult to prove in court because the touching could have been interpreted as being accidental and Holbrook had never before been accused of being inappropriate with students.

She said the decision to drop the charges also was affected by an outpouring of support from Potter Valley residents.

"This was very divisive to the community," Lintott said.

A psychological exam also was favorable to Holbrook, she said.
Holbrook's agreement to resign from teaching at Potter Valley largely alleviated the concerns of the families of the girls who complained, Lintott said.

TT - The original story said there were five or six victims between the ages of 14 and 18. Nice life lesson for those girls, isn't it?

Robert Ewing, 40, a South Spencer High School teacher, was arrested on theft, criminal confinement, and domestic battery charges for allegedly accosting his wife.

Ewing is a math and science teacher and boys and girls cross-country coach.

CHARGES DISMISSED - May 8, 2008
A motion to dismiss without prejudice was filed May 8, 2008 by Deputy Prosecuting Attorney Neil C. Thomas because:
1. The victim in said cause has refused to cooperate with the prosecution.
2. That there is no independent corraborative evidence which would allow the State of Indiana to go forward with the prosecution of the above-captioned case.
Filed in Vanderburgh Superior Court.

CHARGES DISMISSED

Jan 18, 2007 - Donna DeWeese, 55, a social studies teacher at Francis Howell North High School, was indicted by a grand jury on a felony stealing charge, accused of taking $16,000 from the Class of 2007's prom fund. She was a class sponsor who oversaw such things as the prom.

Administrators at the School noticed a discrepancy in accounts for the 2006 prom. The district began an internal investigation and turned it over to police when they determined it could be a criminal matter.

DeWeese was placed on paid administrative leave Aug. 29. She has been on unpaid leave since she was charged. The grand jury indicted her Nov. 29.

CHARGES DISMISSED July 28, 2008 - St. Charles County prosecutors on Monday dismissed charges against 56-year-old Donna DeWeese. DeWeese agreed to pay the district $4,500 to recover the cost of insurance coverage for the missing funds. (From Education Week)

From St. Louis Post-Dispatch (July 28) . Charles County Prosecutor Jack Banas said this morning that the thefts couldn't be proven beyond a reasonable doubt. The school district had one amount for the missing money, St. Peters police another and an accountant hired by DeWeese had yet another number, he said.

Ultimately, Banas said, prosecutors decided to drop the charge after DeWeese paid $4,500 in restitution to the school district's insurance fund.

Rice Lake, WISCONSIN

ALL SIX CHARGES DISMISSED IN PLEA AGREEMENT.
HE AGREED TO RESIGN AND surrender his state teaching license.

Oct 6, 2007 - David M. Suino, 47, a fifth-grade teacher at Tainter Elementary School, was arrested after staff members at the school gave statements to law enforcement that they felt a fellow teacher's touching of a 10-year-old male student was inappropriate.

Suino was charged with one count of misdemeanor disorderly conduct. The case remains under investigation.

Feb 5, 2008 - Suino is due in court today. He faces a half-dozen disorderly conduct charges. Six boys are listed in the criminal complaint, four of them were in Suino's class this year, two others say Suino touched them two years ago.

Rice Lake Police say there could be more victims. Suino is on paid administrative leave from his teaching job.

FINAL PRE-TRIAL SCHEDULED - June 23, 2008

PLEA DEAL June 23, 2008 - All six charges of disorderly conduct were dismissed Monday in Dunn County Court. As part of a plea agreement, the charges were dropped against Suino. Suino agreed to resign his teaching position with the Rice Lake school district and surrender his state teaching license.

New Bern, NORTH CAROLINA

Judge Peter Mack asked both parents at the end of their testimony if they felt that their children had been physically assaulted. Both said "no."

CHARGES DISMISSED

April 30, 2008 - Philip Beeson, 53, an East Forsyth High School teacher, faces charges of assault on a female in his new school district.
Phillip Beeson taught and was an assistant football coach in Forsyth County until 1998. While there, he was one of five coaches accused of drinking alcohol on school property, and threatened
with dismissal. A spokesperson for the school district says Beeson resigned in 1998.

The Winston-Salem Journal (Apr 30) reported more on the prior accusations.
In Forsyth County, Beeson resigned from his position as a teacher and assistant football coach at East Forsyth after an incident reported in November 1998 that involved six teachers at the school. Beeson was suspended without pay when the allegations surfaced.

One of the teachers, Douglas Shields, was accused of videotaping himself having sex with two female students and showing the tapes to others. In 2001, Shields pleaded guilty to one count of disseminating obscene materials and one count of third-degree sexual exploitation of a minor.

School officials said at the time that Beeson knew about Shields' conduct and failed to report it.
Beeson now teaches and coaches girls' basketball at New Bern High School in Craven County, where he was suspended with pay after allegations of inappropriate touching surfaced.

TT - Parents complained in May about the delay in addressing student complaints.

June 11 - CHARGES DISMISSED

Two misdemeanor charges of assault on female students filed by police against a New Bern High School teacher and coach were dismissed Wednesday in Craven County District court.

The teacher, Phillip Beeson, was freed of the charges after two teenage girls in the case had their attorney, Michael Mills, request that their subpoenas be quashed.

One girl's mother and one girl's father testified that neither family wanted to talk to police or press criminal charges against Beeson. Both parents said they didn't think Beeson had assaulted their daughters.

Douglas Jarman, father of one of the girls, testified that he told police that he wanted the school to handle the situation. Elizabeth Nichols, the mother of the other student, testified that the parents refused to let their daughters talk to police investigators. Both said the school system failed the students.
