Dublin, OHIO

October 23, 2008 - Two former Dublin Coffman High School boys lacrosse coaches were sentenced to prison in Tennessee for assaulting a lacrosse player in 2006 while the team was on a trip to Memphis, Tennessee.

The two former coaches pleaded guilty to the assault charges in August as part of a deal that dropped felony rape charges against both of them. The school district fired both of them in the spring 2006.

Dustin Pentz, 28, a volunteer lacrosse coach was sentenced Wednesday, Oct. 22 to 30 days in prison, with the remainder of his 11-month, 29-day sentence to be served on probation.

Another volunteer coach, Greg Simpson, 26, was sentenced to 15 days in prison and to serve the remainder of his six-month sentence on probation. Simpson will have to turn himself in Dec. 1st.

The victim, now a 21-year-old Ohio University student, testified that Simpson, 29, held him down on a team bus while Pentz, 28, inserted gloved fingers into his rectum during a trip to Memphis in March 2006.

The victim said it was a traumatic sexual assault. The former coaches characterized it as a case of horseplay, what they called "goosing." Pentz said he never put his hand inside the boy's shorts, and Simpson denied taking part at all.
The victim has filed a civil case against the team coaches and Dublin school district. That case is pending in federal court.

Greg Simpson's father, Frank Simpson, was convicted of witness intimidation in February 2007 and ordered to pay a $1,000 fine.

Troy, OHIO

A very courageous girl.

ARRAIGNED
Dec 13, 2007 - James H. Clay, 41, basketball coach at Troy Christian School, pleaded not guilty to one felony count of sexual battery for alleged sexual conduct with a 15-year-old girl.

Clay was a coach at Troy Christian School for about two years before he was fired in February. The firing was unnrelated to the sexual misconduct allegations. Clay was indicted by the Grand Jury.

Clay was charged earlier this year as part of an investigation by the sheriff's department but the charges were dismissed in favor of presenting evidence to a grand jury. The charge is sexual battery because at the time of the alleged conduct, Clay was in a position of trust as a coach.

CONVICTED August 28, 2008 - A Miami County jury that deliberated for around 80 minutes before finding Clay guilty of felony sexual battery.

Jurors reviewed all evidence, particularly a tape of a call the girl made in summer 2007 to Clay, asking him about videotapes she said he made of two sexual encounters. As the girl talked briefly with Clay, sheriff's Detective Mark Slater sat nearby.

"The tape was probably the most damaging," foreman Mark Herkins of West Milton said. Jurors listened to the tape four to five times, he said, adding, "We tried to listen to every word." On the tape, Clay tells the girl the tapes had been destroyed.
After the verdict, she thanked supporters.

OF NOTE: Lawyers challenge jury pool.
On Tuesday, Clay's lawyers challenged the county's jury pool because there were no blacks among the more than 40 people called for possible jury service. The lack of minorities, they argued, took away the right of a jury of his peers for Clay, who is black.
A couple of days after Clay was charged in December, his house burned. The fire was ruled an arson, but no one has been charged. Prosecutors are waiting for a final investigation report from the sheriff's office. Clay will be sentenced October 14.

SENTENCED October 14 - Clay was sentenced to the maximum - five years in prison for sexual conduct with a 15-year-old student. Clay is 41 years old.
Clay cried as he asked Judge Jeffrey Welbaum for mercy for him and his family, saying the past year has been filled with pain for his children, who have been harassed, and his loss of five jobs because of the criminal charge and conviction.

"I just want peace for my family and peace for (the victim's) family," he said.
Judge Welbaum reviewed Clay's criminal record, which he said included 26 convictions mostly between 1988 and 1997, including multiple assaults and driving under suspension.

Clay was classified a Tier III sex offender, requiring him to register his address with the sheriff in the county where he lives for the rest of his life.

Cue Twilight Zone music.

September 27, 2008 - Daniel Kincaid, 46, principal at Emerson Academy, a Dayton charter school, was arrested this week after leading Indiana police on a chase on Interstate 70 after which he told officers he sometimes "loses touch with reality" and was afraid every car around him was chasing him.

Kincaid was charged with fleeing, resisting arrest, reckless driving, criminal recklessness and possession of paraphernalia, police said.

Madison, OHIO

August 27, 2008 - Madison Schools Superintendent David Williamson pleaded no contest on two misdemeanor charges of attempted sexual imposition. In two separate incidents in March, Williamson was charged with unwanted sexual contact with the 27-year-old female janitor at the school's board office.

Williamson changed his not guilty plea to no contest in exchange of the charges dropping from two counts of sexual imposition to two counts of attempted sexual imposition. After being charged, Williamson was placed on paid administrative leave by the Madison School Board, but was later reinstated and given a one-year contract extension.

RESIGNATION Sept 4 - Williamson resigned. The Madison Schools Board of Education accepted the resignation at a special meeting Wednesday night. The board did not buy out his contract. He will be paid for vacation days he earned. His health insurance will carry on until the end of September, but his salary will stop with his resignation.

See Madison residents concerned by BOE’s stance on Williamson (Aug 27)

"I would like to state that I was very distressed when you, the board members of the Madison Local Board of Education, voted to reinstate Dr. Williamson to the position of superintendent while he had alleged charges of sexual imposition against a fellow employee pending,” said Donna Hammond, librarian at Mifflin Elementary School and a 15-year Madison employee.

“It showed an extreme lack of judgment which was then exacerbated by a vote to extend his contract. These decisions were an affront to the morale of district employees, a dereliction of your duties to the taxpayers of this community and a disgusting example of morality for our students. And now the truth is out.

“Dr. Williamson may have extraordinary tendencies, but I don’t think they’re of the walk-on-water variety. By your actions, you have made a tawdry and scandalous situation worse and subjected taxpayers, employees and students to public humiliation and derision. I have no faith in your ability to intelligently lead this district in the future and I publicly ask that all five board members tender your resignations as soon as possible and invite employees and taxpayers to request the same.”

Hammond’s statement provoked applause from the audience.

Troy, OHIO

The store employee called 911 to report an adult male "loving on" a young girl in the furniture department.

September 4, 2008 - Jared Wolfgang, 28, a Troy schools music teacher and assistant band director, pleaded guilty to three misdemeanor charges of contributing to the delinquency and unruliness of a minor.

Wolfgang was arrested by Troy police July 15 after a Meijer store employee called 911 to report an adult male "loving on" a young girl in the furniture department. Police said love letters and notes from the girl, a 15-year-old student, were found in Wolfgang's car.

Troy school officials said Wolfgang resigned in late May after he was put on leave while officials investigated complaints by the same girl's parents that he had been exchanging messages with her. Superintendent Tom Dunn said the messages were inappropriate between a student and teacher, containing "juvenile stuff," not sexual conversation.
Wolfgang had been employed by the Troy schools for one year. He previously had worked for the Newton School District, also in Miami County.

Mentor, OHIO

The boy had just completed ninth grade.
Former Student Teacher of the Year at her college and sex acts in a classroom before school started.
Sentenced to three years in prison.

June 19, 2008 - Maggie Laughlin, 23, a math teacher at Shore Junior High School, was arrested Wednesday and arraigned Thursday on one count of of sexual battery and one count of unlawful sexual conduct with a minor.

Sex acts with the student, who just completed ninth grade, were conducted in a classroom before school started, said Capt. James Telzrow.

The relationship with the 15-year-old male began in May. Laughlin resigned in June. She had been with the district less than a year.

First article says that the authorities became aware of the relationship when the boy's ex-girlfriend's mother contacted a school official. Second article states that "Administrators say they were informed of the alleged sexual contact between teacher and student by another student on June 12 and immediately notified Mentor Police."

"This crime is a devastating betrayal of the fundamental trust that parents put in their children's teachers ever day," said Dr. Jacqueline Hoynes, superintendent of schools.
. . .
"We are grateful that one of our students had the courage to tell a teacher about this situation," Hoynes said. "It is so important that students take the appropriate action when they have information like this, and we will continue to strive to create an environment in our schools where students can do so."
Article at the Cleveland Plain Dealer states that another student told a coach about the sexual activity. Police and school officials said there were eight to 10 incidents of sexual misconduct between the student and the math teacher but not intercourse.

She is originally from Dayton and had been Student Teacher of the Year at Heidelberg College, where she graduated magna cum laude in 2007, according to the school's Web site.

Laughlin had resigned from Shore on June 9 - before the police investigation began - and planned to move to Michigan, officials said.
June 20 - Teacher faces sex charges (News-Herald)
Laughlin performed oral sex on the boy before classes. It happened eight times between May 28 and June 12, when the alleged relationship came to light.

Officials learned about the suspected relationship through the boy's former girlfriend. When the boy told her he was cheating on her with a teacher, she was too upset to go to sports practice. She told her mother, who told her coach, who informed Shore Junior High School Principal Doug Baker, police said.
Laughlin had been planning to move to Michigan with her fiance, which is why the prosecution asked for a higher bond. The judge set it at $200,000.

Laughlin's preliminary hearing is scheduled for June 26.

GUILTY PLEA August 13 - Laughlin pleaded guilty to Wednesday to eight counts of unlawful sexual conduct with a juvenile.

"I became involved with a student and the relationship became sexual in nature and I performed oral sex on him," Laughlin said to Lake County Common Pleas Court Judge Paul Mitrovich.
She will be sentenced later this month.

SENTENCED August 28 - Laughlin was sentenced to three years in prison, the time requested by the prosecution. The job at Shore teaching math was Laughlin's first teaching assignment out of college.

From the Cleveland Plain Dealer: (August 28) She claimed the ninth grader initiated the relationship when he got access to her cell phone number and began sending her text messages. Assistant Prosecutor Jason Wuliger said Laughlin on her behavior.
"She corrupted the school, lied to other teachers and asked other students who witnessed the behavior to keep her secret," Wuliger said.
Lake County Common Pleas Judge Paul Mitrovich sentenced her. "As a teacher you were placed in a position of trust," Mitrovich said. "You showed uncaring selfishness on your part."

Laughlin will be a registered sex offender for twenty-five years.
School officials and a lawyer talk to first-year teachers about inappropriate behavior in the classroom, including what constitutes sexual battery, before the school year begins, Carrabine said.

"This year we specifically addressed Maggie's incident and hammered it home," he said. "We told teachers never to meet with the student one on one with the door closed, never to meet before school starts and not to meet with a student without an administrator in the building."
Laughlin will relinquish her teaching license and have to register her address every six months for the next 25 years.
November 3 - Three months after being sentenced, she is seeking release.
----------------------------
TT - Several things require comment. One, her license should be revoked automatically upon such a conviction. That would be a punitive action and speak positively about how the educational bureaucracy views such behavior. It is automatic in Ohio but it also means the teacher has the right of appeal. Still, it sends a bad message.

Secondly, teacher training in a lot of school districts is conducted by a teachers union lawyer or a lawyer for the school district whose focus is on district liability and false accusations and how to avoid them, not on how teachers have a moral obligation to students and to their parents to avoid sexual exploitation of students.

That's hardly the kind of ethical training you want for your child's teacher. And it leads to a widespread belief by teachers and administrators that when a student complains about sexual exploitation, the charges have no merit. It is automatically thought of as false, malicious and slanderous, rather than indecent, immoral and disgusting behavior on the part of the teacher.

For those teachers who do see the colleague's behavior as unethical and illegal, they can't miss the broadest implication. Turning in another teacher isn't in the game plan and shouldn't be in theirs, not if they want to be defended by the same union lawyers if they should be accused. And not if they want to be supported by the administration. Such training should be conducted by a local prosecutor and police detectives.

Hopefully, one of the really, really good newspapers, like the Columbus Dispatch that has done so much to bring accountability, open records and responsible legislation will investigate the so-called teacher training programs in school districts in the state.

Casstown, OHIO

August 15, 2008 - Chad Widener, 37, a history teacher at Miami East Junior High School, was indicted by a Miami County grand jury on one count of felony importuning.

In February, the parents of a 15-year-old girl reported to police that they had been having issues with their daughter regarding sending and receipt of "inappropriate" e-mails and text messages, so they installed a spyware program on the computer. They said the program intercepted a text message between the girl and an unknown male that occurred Dec. 6 and contained "sexual statements" by the male, the report said. A sheriff's investigation identified Widener through phone records.

Widener joined the district as a special education teacher and coach in 1995. He resigned in August. An arraignment is scheduled for August 22.

Widener's father is a Miami County commissioner. The investigation was turned over to a special prosecutor in Shelby County by Miami County Prosecutor Gary Nasal. Nasal, whose office serves as legal counsel to the county commission, said Ralph Bauer, Shelby County prosecutor, handled the case to avoid any appearance of impropriety by the local office.

The Columbus Dispatch performs a valuable public service by publishing the names and legal histories of teachers who have their licenses revoked.

The State Board of Education voted to permanently revoke licenses for three.

Fayette, OHIO

INDICTED April 3, 2008 - Tabatha Fidler, 27, a health and physical education instructor at Gorham Fayette High School, was indicted this week by a Williams County grand jury with one count of sexual battery for sexual conduct with a 16-year-old boy.

Fidler was placed on paid administrative leave in January, when the district was first made aware of the accusations against her. She is accused of having sex with the boy last June in her home. She is due to appear in court April 10th.

NOT GUILTY PLEA April 10 - Fidler pleaded not guilty.

NBC 24 found Fidler's profile on a teacher website. In it she says that she's an athlete and that if she could change one thing in her life, it would be to not be so "boy crazy."

Fidler is a single mother, raising a son. Her husband died suddenly last Christmas.
A pre-trial hearing is scheduled for April 30.

GUILTY PLEA & SENTENCING July 16 - Fidler changed her plea from not guilty to guilty in June after a second charge was added.
The first charge was based on accusations that she had sexual contact with a boy on one occasion in June, 2007, at her former home in Montpelier, Ohio.

The other charge was based on earlier incidents with an 18-year-old student in April and May, 2004, when she taught in the North Central School District in Pioneer, Ohio.

The earlier incidents arose through anonymous letters and e-mails sent to the county prosecutor's office, county Prosecutor Thomas A. Thompson said.
She was sentenced on two felonious sexual battery convictions to two concurrent three-year prison terms.
-------------------
LEGAL INFO: (from story) Under Ohio law, sexual battery includes engaging in sexual conduct when the offender is a teacher and the other person is a minor.—in this case, a 16-year-old boy. The charge is a third-degree felony. Each charge carries a prison term ranging from one to five years.

Columbus, OHIO

Feb 26, 2008 - Kevin M. Chapman, 51, an art teacher boys swim coach at Upper Arlington High School was arrested today and charged with two counts of rape and one of sexual battery.

He was arrested in the high school office about 2:15 p.m. The district was unaware of the investigation before police arrived at the school. Chapman was charged based on incidents in 1996 and 1997. The victim was a girl who was 15 at the time.

Chapman has worked for the district since 1989. District records say he was paid $81,616.

Upper Arlington police ask anyone who contends they were a victim of Chapman to contact them at 614-583-5160.

BOND - Feb 27 - A judge ordered Chapman held on $25,000 bond.

After the hearing, Chapman's attorney said he had concerns about why the now 28-year-old woman brought the allegations to light, Hirsch reported.
TT - How about because she grew up and got the courage to confront the creep? How about a 15-year-old student sexually abused by a then-38 or 39 year old teacher isn't up to confronting authority? And how come attorneys for priests never questioned the motives of victims?

POSSIBLE PLEA AGREEMENT May 7 - Franklin County Prosecutor Ron O’Brien said Chapman has agreed to plead guilty to to sexual battery and unlawful sexual conduct with a minor charges for having sex with a former student in the 1990s. The agreement came a day after Chapman resigned from the school district. He is is expected to enter the plea on May 19.
---
No online press release yet from the Franklin County Prosecutor's office.

SHOCK AT PLEA May 8 - "The shock that was felt by dozens of Upper Arlington students and families became all the more real Wednesday, May 7." - when they found out that Chapman agreed to plead guilty. Chapman resigned Wednesday (May 6) before agreeing to plead guilty to the charges made against him. He had been on paid administrative leave since the arrest, with a full-time replacement hired for him last month.

GUILTY PLEA May 19 - Chapman pleaded guilty to one count each of sexual battery and unlawful sexual conduct with a minor.
The teacher has admitted having sex with the student at least three times in one year in classrooms at Upper Arlington High School, [Assistant County Prosecutor Daniel] Hawkins said.
He will be sentenced July 11.

SENTENCED July 15 - Chapman was sentenced to five years in prison. for the sexual battery and 18 months for unlawful sexual conduct with a minor to run concurrently.

The victim read a statement.
"I was only 15; I had never even been kissed by a boy," the woman said, reading from a seven-page statement. "Chapman had talked so much about his sexual escapades from college that I thought that maybe this is what cool college kids do and that maybe he really liked me the most or was even falling in love with me."
The judge said his supporters, including those who wrote letters, don't understand the abuse the woman endured. "There is another side here. We have an adult who was preying on her," Pfeiffer said. "Prison is the only appropriate response."

It is likely that Chapman will be a registered sex offender, but the judge will allow arguments that the that the law cannot be applied to a crime that was committed before it was enacted.

West Milton, OHIO

His attorney said his client understands one thing now. “He needs to hang out with people his own age.” Ya think?

Nov 28, 2007 - Anthony Spahr, 28, assistant director of the Milton-Union High School band, was arrested. He was indicted on one count of sexual battery. He is accused of having a sexual relationship with a minor.

He was not a teacher in the district. Spahr passed a district background check before his hiring in a supplemental contract.

School officials recieved a call in October that said Spahr was involved with a minor. At their request, he resigned.

The investigation continues with additional charges possible. Video report suggests there is a second victim.

SECOND INDICTMENT Dec 7 - Spahr was indicted this week on a second sexual battery count alleging illegal sexual activity this summer with a 17-year-old girl, also in West Milton.

Before going to Milton-Union, Spahr worked with bands at Troy High School and Newton High School. Troy school officials said Spahr resigned from a similar job with the Troy band in 2002 following allegations of misconduct.

Troy Schools Superintendent Tom Dunn said Spahr resigned when told of an investigation into allegations he supplied alcohol to a band member during a band trip to England.

Separate allegations of sexual misconduct with a student also were made, according to a letter from a Troy school administrator to the county Educational Services Center. Spahr worked at Troy High School as an individual student aide through the services center.
He is scheduled for arraignment on the second charge Dec. 13.

ARRAIGNMENT Dec 13 - Spahr was arraigned. He pleaded not guilty to one count of sexual battery for alleged sexual conduct this summer with a 17-year-old girl in West Milton while employed as an assistant band director at Milton-Union schools.

Spahr already was being held on $20,000 bail set at his arraignment in November on another count of sexual battery. That charge alleges sexual activity with a 16-year-old girl at his apartment in West Milton. Sheriff's deputies and prosecutors said this week they continue to investigate Spahr and more charges are possible.

PLEA WITHDRAWN April 30 - Spahr has withdrawn his no contest pleas entered April 11 to two counts of unlawful sexual conduct with a minor. Trial is set for June 4.

COMMENTS DIABLED May 10 for excess of unproductive rants. If you want to post something, send an e-mail.

SENTENCED July 19 Spahr was found guilty on the attempted gross sexual imposition charges in a plea agreement. Spahr was sentenced Friday to two years in prison (the maximum allowable term) and will be labeled a sex offender for the next 15 years.
The mother’s statement was read shortly after Spahr read a prepared statement of his own that expressed his remorse for what he had done to those “two young ladies.”

But sentencing Judge Jeffrey Welbaum questioned that remorse after he received a letter Thursday from one of the victims who said she and Spahr never had a sexual relationship, and Spahr’s attorney, Chris Bucio, added at the hearing his client states the same.

“As far as remorse, not only is there no remorse, but there is collusion between him and her,” Welbaum said from the bench.
A presentence investigation issued to the court contained other allegations, including that Spahr was involved in other inappropriate behavior while employed in a similar capacity at Troy High School.

Love letters to a 13-year-old girl.

Oct 25, 2007 - A judge ruled that Richard Prusha, a Harrison Hills Junior High School language arts teacher accused of sending love letters to a student, can have contact with female juveniles. The judge removed all bail restrictions.

Prusha is on paid administrative leave.

NOT GUILTY PLEA Prusha pleaded not guilty in May to stalking in connection with several love letters he wrote to a 13-year-old student. The girl's mother found the letters and turned them over to the school.

Prusha's trial is scheduled for Jan. 8. [We cannot find Prusha's age, but he looks to be over 35.]

TRIAL DELAYED (Again) May 7 - Prusha's trial has been delayed again on fourth-degree felony menacing by stalking charges. Scheduled to go on trial May 5, the court postponed the trial to allow a civil case in the matter to continue.

GUILTY PLEA & SENTENCING July 8, 2008 - Prusha pleaded no contest to a lesser charge of criminal trespassing. He was sentenced to 30 days in jail - not prison - and 18 months of probation.

At his sentencing Monday, Prusha appeared remorseful.
"I am truly sorry that she's gone through what she's gone through and I apologize to her and her family," he said.

The victim's mother said she was proud of her daughter "to be able to come forward to me (with) what her fears or suspicions were."

Logan, OHIO

We don't understand either.

July 2, 2008 - Bernard C. Montgomery, 58, a Logan High School teacher, was in court for a pre-trial hearing. He was charged with four counts of contributing to unruliness for allegedly taking two students out of school and taking them to Florida. Without, it seems, the knowledge or consent of their parents or the school.

According to an affidavit from a search warrant executed Dec. 19, Logan High School Principal Jim Robinson was first alerted by a parent about possible inappropriate relations between Montgomery and two students in early December.
The defense attorney challenged the lack of specificity.

Judge Rick Wallar ordered Hocking County Prosecutor Larry Beal to amend his original complaint against Montgomery by Thursday.
--------------------
July 3, 2008 - Out with the old, in with the new
Recent allegations against a teacher of the Logan-Hocking School District regarding his accompanying students on a trip out of state were brought to the attention of the school district administrators by students and parents. Immediately, school administrators contacted local police and informed them of the allegations and provided them with all information so they could thoroughly investigate the matter.

After the allegations arose, the teacher did not return to school but was placed on administrative leave. On Dec. 28, the teacher submitted his resignation and will not be returning to work.

Public indecency for allegedly exposing himself.

June 26, 2008 - Brian Weinewuth, 31, a math teacher at Fairfield Middle School, was arrested and charged with exposing himself to a woman and a juvenile at the pool of a health club.

Montgomery Police said Weinewuth admitted to the crime after he was arrested. The juvenile girl is 17 years old, and the other person is her older sister.

Weinewuth was hired in June 2000 and coaches football for 7th and 8th graders at the middle school. He coaches varsity baseball at Fairfield High School.

June 27 - Teacher charged with public indecency (The Oxford Press)

The alleged incident appeared to be random, said Montgomery Police Lt. Jerry Breitman.

"There was no conversation; he simply exposed himself," Breitman said. "When we got there, he had left the scene, but through some investigative work we were able to identify him."

When questioned by police, Weinewuth admitted exposing himself to the sisters, Breitman said.
A pretrial hearing is scheduled for July 21.
