Let's get this straight. She's guilty of statutory rape but not crossing the border to have sex with a minor?

March 6, 2008 - Kelsey Peterson's lawyer wants get the federal case against her dropped in exchange for her pleading guilty to state charges of statutory rape.

The lawyer said in the U.S. District Court in Omaha that if he can't settle the federal case, he wants the court to order the boy's mother to be deposed. The lawyer says Peterson told him that the boy's mother advised them on the logistics of their trip.

TT - What the boy's mother did or did not do is irrelevant to either federal or state charges. However, he knows that Federal charges will likely be more onerous. There's no parole in federal sentencing and his client is likely to be on supervised probation for the rest of her life if convicted in a federal court.
