Teacher who had a drunken sexual encounter with two Redwood High School teenagers last year was sentenced.

Amy Lee Kelly, 41, a teacher at Bacich Elementary School until the spring of 2006, was arrested and charged with having sex with two 15-year-old Redwood High School boys during a drunken encounter in Corte Madera.
Charged with two counts of lewd acts upon a child and one count of unlawful sexual intercourse, she pleaded not guilty.
The case stems from an incident on Oct. 20, 2006, when Kelly went to the home of a friend in Corte Madera. Kelly started drinking beer and red wine and became so intoxicated that her friend took her car keys away, according to an affidavit filed by Mitchell.Later, the daughter saw the other boy with Kelly. She also took pictures of the naked defendant with one of the boys. Kelly is divorced with two children. A preliminary is scheduled for September 6.
That evening, the 15-year-old Redwood High boys showed up at the house to visit the daughter of Kelly's friend. Both boys had consumed alcohol.
At some point during the visit, the daughter noticed that one of the boys was no longer downstairs. She went upstairs and saw the boy and Kelly engaging in sexual activity on her bed, the affidavit said.
OUTRAGEOUS Sept 7 - Outside of the courtroom, Kelly's attorney suggested she might have been the victim of a sexual assault by the boys. He isn't saying it's rape yet. A preliminary hearing is scheduled for Oct 31.
GUILTY PLEA - April 23, 2008 - At what was supposed to have been a preliminary hearing, Kelly pleaded guilty to one felony count of oral copulation of a person under 18 years old and one misdemeanor count of battery. Under the plea agreement, she will not have to register as a sex offender. She will be sentenced June 11.
She resigned the job in June 2006, several months before the sexual encounter.
SENTENCED (sorta) June 11 - Kelly was sentenced Wednesday to nine months in county jail - not prison. She was ordered to surrender to the jail on July 17, but she might be released shortly thereafter to serve her sentence under home detention.
She will be on supervised probation for five years. Kelly is barred from consuming alcohol or drugs during her probation and cannot visit with any minors except her own children. The judge also ordered Kelly to be examined for sexually transmitted diseases and report any positive results to the parents of the teens.
Kelly has two children. She could have faced up to three years in prison.
