May 3, 2007 - John Aubrey, a Vinton County High School teacher and coach, was sentenced to six years in prison for three counts of sexual battery. Aubrey was also a former Wellston councilman.

His sentence includes five years of post release control. The judge also designated Aubrey as a sexually oriented offender.

PLEA BARGAIN Aubrey was originally charged with 19 counts of sexual battery, all third-degree felonies, stemming from accusations of improper behavior with underage students. A plea bargain with the Vinton County Prosecutor's Office reduced the number of charges to three. The plea is an Alford plea. [No contest.]

SENTENCED He was sentenced in January to 20 months in jail after being found guilty of improperly handling of a firearm.

His attorney argued for leniency because because the victims were older minors and not young children.

APPEAL DENIED: The Ohio 4th District Court of Appeals denied Aubrey's request to overturn his conviction of knowingly transporting a firearm improperly while under the influence of alcohol with a firearm specification.

Following a jury trial, Aubrey was sentenced to 20 months in prison by visiting Judge Thomas Gerken. The judge bumped up Prosecutor Tim Gleeson's recommendation of six months for the charge of improperly handling a firearm and one year for the gun specification, saying the severity of driving intoxicated mixed with firearms warranted more time.
The six-year term to be served concurrently with the 20 months for the firearm charges.
