Millbrae, CALIFORNIA

March 12, 2008 - David Lista, 35, a English and leadership teacher at Mills High School, was arrested Thursday. Police said he admitted filming female students in an adjoining bathroom. Charges will be determined for the videotaping.

Lista's classroom is located next to the bathroom where the images were taken from a camera placed in the ceiling, police and school officials said. "What happened was he accessed the false ceiling, which was a series of panels, and had broken out a small piece," Aronis said. School officials said the confiscated images, which police say were captured over one to two months, show 19 people using the bathroom.

A technology coordinator found the images on a school computer server. Police were notified and Lista was arrested when they found a small amount of methamphetamine in a search of his home. Lista taught at the school for seven years. [Another story says 10 years.]

Students at the school complained that Lista had other things on his mind. He consistently failed to grade papers and students passed a petition to get him to return papers. They took the petition to the principal.

Several students also said Lista was caught up in an episode last year involving links on his YouTube video-sharing account. "I saw it myself," said Alfred Tam, a senior who was in Lista's leadership class. "He had links to his 'favorites' that were all these videos of underage girls dancing in bikinis." The links were passed around the student body, Tam said.
School principal Paul Belzer declined to comment on the petition or the YouTube videos .[ TT - "It's a personnel matter." Translation: How dare you question our authority?] The union has offerred to lawyer him up.

Teachers' association president Craig Childress said Lista, who has been placed on administrative leave, is entitled to legal representation through the union.

"We've made attempts to notify him of his rights to representation," Childress said. "I'm not aware of whether he has taken that opportunity."
Arraignment is scheduled for April 8. The charges will depend upon whether he traded the images or not.

NEW CHARGES - CHILD PORNOGRAPHY April 4, 2008 - Lista was charged Friday with four felony child pornography counts, including possession of the mateirl with the intent to distribute, after investigators discovered that his home computer contains hundreds of pictures and videos of child pornography.

Lista admitted to the allegations that he filmed the students, police said. But prosecutors waited several weeks to charge him while FBI investigators examined the teacher's home computer for child pornography. Arraignment is scheduled for April 8.

ARRAIGNED April 8 - Lista was arraigned and remanded into custody this morning on drug and pornography charges. He pleaded not guilty. A preliminary hearing is scheduled for Lista on July 29.

HIDDEN CLASSROOM CAMERA April 9 - Lista also peeped on students using a hidden camera stashed under his classroom desk, prosecutors said Tuesday. Police found 20 images of students he had filmed during class — from a camera pasted under his desk - on a separate computer seized from his home. His home computer also contained hundreds of other pictures and videos accessed from a wide-reaching child pornography trade, investigators said.

BAIL CONDITIONS April 15 - Prosecutors asked for increased bail, but the judge denied the request. He did add stipulations that Lista cannot contact or be around minors, be around elementary, middle or high schools and he may only use the Internet to send personal e-mails or job hunt. He is currently out on $125,000 bail.

RESIGNATION April 19 - The San Mateo Union High School District board accepted Lista's resignation during a closed-door meeting Thursday night. Police said they also seized a small amount of methamphetamine at Lista’s home.

ARRAIGNMENT for COCAINE May 16 - Lista was arraigned for possession of cocaine. Lista was stopped by San Mateo police April 4 because they thought his driving seemed impaired. After questioning, Lista handed the officers a snorting tube with a quarter gram of cocaine. He is also facing one felony charge for drugs that were previously found at his home. A preliminary hearing is scheduled July 29 on the drug and pornography charges.

POSSIBLE PLEA AGREEMENT Aug 14 - Prosecutors have offered David Lista an undisclosed plea bargain but are holding off on formalizing any agreement. “We want to check into a few items first,” said Chief Deputy District Attorney Steve Wagstaffe, declining to elaborate.

PLEA AGREEMENT - August 29 - Lista pleaded no contest Thursday to felony charges of possession of child pornography and possession of methamphetamine, and misdemeanor charges stemming from the taping of girls in the bathroom and his classroom.

A misdemeanor charge of cocaine possession was dismissed. He will have to register as a sex offender. Lista is scheduled to be sentenced Oct. 30. A court-appointed psychiatrist will evaluate Lista before sentencing to determine whether he should be considered a sexual predator.

SENTENCED November 25 - Lista was sentenced Monday in San Mateo County Superior Court to two years in state prison. The three sentences to run concurrently — two years for drug use and possession, 16 months for possession of child pornography and 60 days for misdemeanor counts of improper peeping. Lista must also register as both a sex offender and narcotics offender.

Kokomo, INDIANA

Hindson was not an educator but a swim coach at a local school where he had a hidden camera in the girls' dressing room for ten years.

Feb 7, 2008 - When a police detective viewed videos taken from a computer the swim coach sold through eBay in 2006 to a buyer in Gastonia, N.C., the detecive found the source of the files.

"Upon viewing the videos, Det. Banush went to the girls swimming locker room at Kokomo High School's Memorial Gym and determined that the video discovered by [the computer purchaser] on her computer was in fact produced in that locker room in Memorial Gym," the search warrant affidavit states.
A search warrant was served Tuesday on the coach's residence. They seized 65 items. On Wednesday, school officials met with parents of both female and male students and confirmed an investigation was taking place, and that some children may have been taped undressing in the female locker room.

Brian D. Hindson, 40, was arrested today and is now in federal custody. An examination of an external hard drive of a computer in his home obtained during the search contained eight videos of minors engaging in sexually explicit conduct. The complaint does not allege that Hindson produced the videos.

Hindson also admitted to hiding video cameras in the locker rooms at Kokomo High School and Westfield High School.

The buyer of the computer told the FBI about finding the files in 2006 when she and her son turned on the computer. The FBI contacted the North Carolina detective on Tuesday.

This investigation is ongoing. Anyone with information about the case should call the Kokomo Police Department at (765) 456-7248.

He was ordered to serve a LIFETIME PERIOD OF SUPERVISED RELEASE.

Hindson pleaded guilty July 23, 2008.
The statement of facts established that during an approximately 10-year period, Hindson hid video cameras in locker rooms at Kokomo High School and Memorial Gym, and then secretly videotaped female teenage swimmers from his teams while they undressed.

Byron Center, MICHIGAN

In Australia, they call it "upskirting."

August 1, 2007 - Steven Sanger, 40, a Byron Center High School teacher, been charged with taking pictures up the skirt of a 15-year-old student.

The student immediately told school authorities.

Police used a warrant to search Sanger's residence, including all his computers. He was then arrested after a thorough investigation.

On Wednesday, Sanger was arraigned on one count of capturing/distributing images of the undergarments, which carries a maximum penalty of five years in prison.
Source: WOOD-tv 8

Also see Grand Rapids Press story.

PROBABLE CAUSE HEARING: August 16 - A probable cause hearing is underway.

Sanger smiled and nodded at his accuser as she took the stand, after which she broke down in sobs.

The girl said Sanger was her science teacher and her adviser during the past school year, her freshman year. She said she was in class June 12 when Sanger called her to the front of the room to look over a test.

She said the 40-year-old teacher positioned himself so that she was standing between his legs. She was wearing a knee-length skirt.

"I noticed while he was writing answers on the test, he would glance down at something," the girl said under questioning by Kent County Assistant Prosecutor Helen Brinkman. "So I looked down and saw him holding the camera under my skirt."

When questioned by Sanger's attorney, Daniel Watkins, the girl said she was not upset by the grades she received from Sanger and she said that as many as seven people were standing around the area where she claims the crime occurred.

The teen's friend, 16-year-old Jenna Maleport, said she was in the classroom at the time and looking over Sanger's shoulder, she saw a picture of her friend's undergarments on the camera's display screen.
Sept 11 - A judge has determined that there is enough evidence presented to meet the threshold of probable cause a crime may have occurred. Sanger will face felony charges.

June 27, 2008 - A judge has allowed the images found on a digiztal data card found in Sanger's computer bag to be used in his upcoming trial. Three of the images were, apparently, taken in a classroom. The trial is scheduled for August 4.

TRIAL COVERAGE
Aug 6 - Secretary describes teacher as distraught after allegedly taking a picture up student's skirt
She testified that she saw him wandering around distraught and muttering to himself: "I think I went too far this time." "He said he wasn't sure if he'd taken the picture or not," she said.
Aug 9 - Jury finds former Byron Center teacher guilty of taking picture under student's skirt

GUILTY VERDICT August 10, 2008 - A Kent County jury on Friday found Steven Sanger guilty of attempting to capture or distribute an image of an unclothed person. He will be sentenced Sept. 30.

SENTENCED October 7 - Sanger was sentenced to six months in jail after getting a 15-minute tongue-lashing from a Kent County Circuit Court judge Judge Paul Sullivan.
Even though the county probation department suggested no jail time, Sullivan said after sitting through the entire trial held in August, he is convinced the jury made the right decision. Capturing images of an unclothed person is a potential five-year felony and Sanger's sentencing guidelines called for between zero and six months in jail.
"The real damage to the victim in this case was, in my opinion, your maintaining of your innocence," Sullivan told Sanger. "I've got to believe that some of the tears she shed up here were not because of the act but because of the consequences of the act."

Sullivan said he recognizes that Sanger and his family have suffered, but he said it is suffering caused by Sanger's acts.

Sanger's attorney said he had lost his job, his home, his standing in the community and now works for a tool-and-die shop.

He will have to serve 30 months probation following his release.

Armonk, NEW YORK

April 13, 2008 - Quentin Lindsey , 34, head varsity baseball coach at Byram Hills High School, was arrested Thursday and charged with second-degree unlawful surveillance, a felony.

North Castle police were releasing few details about the coach's alleged actions, but said in a statement that, "This investigation revealed the recording of persons who had a reasonable expectation of privacy and was being done without the victims knowledge or consent."

Lt. William Fisher confirmed that surveillance equipment was in the school building, but could not immediately say where in the building it was.
Lindsey was arraigned and released without bail. He is due back in court April 22.

April 14 - N.Y. High School Coach Arrested For Voyeurism Subhead - Cops: Byram Hills Teacher Filmed Girls For 3 Years, Wanted 'Upskirt' Images For Own Gratification
Cops say the hidden videotaping at Byram Hills had been going on for three years.Law enforcement sources tell CBS 2 HD Lindsey had purchased a small video camera which he hid in a backpack, having a cut a hole in the backpack for the lens of the camera.

Then he would leave the backpack in various parts of the school where young women would congregate. The alleged goal was to obtain so-called "upskirt" pictures.

In a criminal complaint, cops say Lindsey, "Did use an imagining device to surreptitiously record the sexual or other intimate parts under the clothing being worn by numerous female students."
Police confiscated his computer.

GUILTY PLEA September 23 - Lindsey pleaded guilty today to guilty to second-degree unlawful surveillance, a felony, for illegally filming female students in school last year.

Long Beach, CALIFORNIA

Acquitted of all charges by a jury.

Sept 17, 2007 - Raul Olivas, 41, Millikan High School head boys basketball coach, was arrested on suspicion of secretly videotaping his 16-year-old stepdaughter after the girl found a camera containing graphic images hidden in her bedroom closet.

The girl was searching for something when she came across the camera trained on a part of the room where she typically dressed. On the camera were images of her in various states of undress.

Police did not identify Olivas, but the Press-Telegram did. Arraignment is scheduled for Sept. 27

June 24, 2008 - Reader said that he was found not guilty. We are trying to find an online story to link to.

ACQUITTED July 11 - A jury last month acquitted a former Millikan High School teacher and coach charged with two counts of secretly taping his 16-year-old stepdaughter for sexual gratification.

Rather, Olivas and a forensic psychologist who testified for the defense - along with Olivas's wife and his stepdaughter - testified that Olivas was suffering from alcoholism, gambling addiction and depression and that he planted the camera in an obvious place as an act of self-destruction.
During the trial, Olivas' three previous DUIs were brought to light as well his prior treatment for alcoholism during a stint in rehab.

ODD NOTE: City Prosecutor Tom Reeves said Thursday that his office made no notice of the trial at the request of the victim and her family. "They were very upset with the previous media coverage," Reeves said. "So we agreed win, lose, or draw we would not publicize the case." [TT - Is that bizarre, or what?]

EVEN ODDER NOTE: According to court transcripts, Dr. Sanjay Sahgal - an assistant professor at USC and the forensic psychiatrist who interviewed Olivas - said Olivas freely admitted planting the camera to tape his stepdaughter and admitted he was attracted to teen girls. The doctor said such attractions are normal for adult males; and that while the act of setting up the camera was immoral and wrong, it was not proof of sexual deviation or pathology. [TT - No. Every father secretly tapes their 16-year-old daughter undressing. Or dreams of it? What the hell is that?]

Billings, MONTANA

Arrested in 2006, he's only now going to go to jail.

Apr 11, 2007 - Paul Patek, 39, a Will James Middle School counselor, who was arrested last October for peeping into a bathroom window at the home of a former student, resigned effective at the end of the school year.

He will continue to be on paid leave until then. (He has been on paid leave since his arrest.)

Patek was arrested Oct. 3 after a call from a woman reporting a prowler outside. When police officers arrived, they found Patek with a video camera standing on a child's desk outside the woman's bathroom window. One of the woman's children was a former student of Patek.

In February, Patek pleaded no contest in to charges of prowling and surreptitious visual observation. He was sentenced, but has since appealed the jail time, arguing that the judge failed to consider that Patek was suffering from the side-effects of an anti-depression medication. He also argues that the judge did not give him credit for the five days he spent in jail after his arrest, and unfairly imposed the sentence based on his economic or social status when she referenced his counseling degrees and said he violated a position of trust. The judge agreed to stay his sentence while the case is under appeal."

State law requires Copps to report Patek's resignation to the Montana State Board of Education, which may decide to pull Patek's teacher and counseling certificate upon review of the circumstances. [TT - the "may" part is scarey. On the other hand, this is the very first Montana arrest since we started this blog last October.]

SENTENCED From the Independent Record, Apr 7, 2007: The judge sentenced Patek to six months in the county jail with all but 30 days suspended on the surreptitious observation charge. The judge added a six-month suspended jail sentence for the prowling charge, and she ordered Patek to follow treatment recommendations from a psychosexual evaluation.

[TT - you can check on the status of Patek's credentials here.]

SENTENCE APPEALED May 25 - Patek's lawyer appealed the sentence, arguing that the city judge did not consider mitigating factors such as the antidepressant medication Patek was taking after the deaths of several family members and friends. He also claimed that the sentencing judge failed to consider his lack of a criminal record. The appeal was rejected by a District Court judge.

MOTION TO WITHDRAW PLEA Update Sept 18 -Patek appeared Tuesday in Billings Municipal Court before Judge Mary Jane Knisely for what was scheduled as a sentencing hearing following a District Court judge's rejection in May of Patek's appeal. But Patek arrived with a new attorney and a recently filed motion asking that he be allowed to withdraw one of his no-contest pleas.

SENTENCED May 24, 2008 - Patek was sentenced to 30 days in jail - not prison - after the judge -imposed a 30-day jail sentence. On May 14th, the judge rejected the motion to withdraw his visual observation plea. He argued he could not be punished twice for what was essentially the same charge.

As of June 18, 2008, his license is still active.

NEW LABEL

After reviewing several cases, Voyerism category was added for labels. Voyerism is not always the charged offense, but the label is for behavior.

Sebewaing, MICHIGAN

Dec 24, 2007 - Joshua J. Brinkman, 27, a Unionville-Sebewaing Middle School teacher, was arraigned on a charge of capturing/distributing an image of an unclothed person. [News story says arraigned, but it looks like it was just an initial court appearance.]

Brinkman was being investigated by the Michigan State Police for allegations that he had a video camera set up in his home and taped female students and one male student undressing at his home on Jan. 14. Five days after the incident Brinkman resigned for "personal reasons."

A pre-preliminary examination has been scheduled for Jan. 14.

ARRAIGNMENT SCHEDULED Jan 15 - Brinkman waived his preliminary exam Jan. 11 and was bound over to circuit court for arraignment on felony charges. The arraignment has been scheduled for Jan 22.

NOT GUILTY PLEA Jan 24 - At his arraignment Brinkman pleaded not guilty. No date for next appearance.

NO CONTEST PLEA April 15 - Brinkman pleaded no contest to the charge of capturing/distributing an image of an unclothed person. He will be sentenced May 12.
--------------
NO CONTEST DEFINED The operation of a no contest plea is similar to a plea of guilty. A defendant who enters a no contest plea concedes the charges alleged without disputing or admitting guilt and without offering a defense. A major advantage of a no contest plea is that it cannot be used against the accused in any civil suit for the same act. It is treated exactly like a guilty plea for sentencing purposes.
-------------
SENTENCED - On May 19, 2008 to five years probation.

Webster City, IOWA

Due to be arraigned, Mofle committed suicide in his jail cell.

Jan 17, 2008 - Shawn Mofle, 41, Webster City Middle School 7th grade basketball coach, turned himself in to police. He is a suspect in a child pornography investigation.

A search was executed at his Webster City home in which police seized computer hard drives and video equipment. Police say what they seized were the alleged production and or possession of child pornography. Mofle is on administrative leave pending the completion of the investigation by the police and school district.

ARREST WARRANT Jan 16 - The material witness arrest warrant was issued by police on Jan 15. The warrant indicates that Mofle is "a material witness to a felony" and that he would not willingly make himself available for subpoena.

INDICTED Mar 1 - Shawn Mofle was indicted in federal court in Sioux City Thursday on eight counts of making and possessing child pornography. Two new charges date back to 2003, according to the indictment filed against him. He’s now also accused of engaging in oral sex with a minor April 21 and July 16, 2003 and making videotapes of those acts, according to the indictment filed against him.

Mar 2 - Police were alerted when Mofle's stepson brought the videotape to them.
On Jan. 12 one of Mofle’s stepsons found a mini DV cassette that had video of boys showering in a locker room. The boy replaced the cassette, according to investigators, and talked to a family friend. The boy was advised to take the video to school or to the police. He found the video camera in Mofle’s bedroom the next day and switched the cassette with a blank one, and then he took the cassette with the locker-room footage to police.
Prosecutors say Mofle hid a video camera in a duffle bag and pointed it at his team while they showered. The indictment reads, "For the purpose of producing visual depictions." Mofle will be arraigned March 6.

SUICIDE March 6 - Shawn Mofle committed suicide today in a South Dakota jail. He was scheduled to appear in court later today. Chief Deputy Myron McDaniel of the U.S. Marshals Service in Cedar Rapids said it appeared that Mofle hanged himself.

Thatcher, ARIZONA

RANT OF THE DAY

Nov 1, 2007 - A teacher is being investigated, the police suspect there may be as many as five victims, the teacher has resigned, the investigation isn't complete, and posters at the news story are already blaming the girls he may have abused.

I find it really sad that a good man with a family is being slandered without any proof to these allegations. Even if there are numerous people coming forward who is to say these girls are not in this together? And who are these girls? They slander poor Mr. Humes, with no hard proof, yet his name is already marked negatively. This community is so judgmental anyways, everyone needs to stand back and open up their eyes.
Another poster,
what did these girls say mr.hume did?i had him for a teacher bout 10yrs ago & he was a good teacher, always willing to help.i don't know what these girls are trying to do but he is a good guy. we all know how some high school girls can be(not all, but some)my thoughts & prayers are with him & his family during this!!but yes i do think the school's should do back ground checks!!as a mom i want to know that my child is in a safe hands when she is not with me! "
And,
I know Mr. Hume and I also really doubt he did what these girls say he did. He has been at Thatcher High forever, at least 25yrs. To the kids at Thatcher High, you lost a really good teacher because of this. "
And another,
Accusations don't mean automatic guilt. There are many times kids will make up stories to get back at someone and then it spreads rapidly. The Salem Witch Trials, for one example. If this misconduct is proved to be true, I do hope Hume will be prosecuted fully. "
TT - Sad thing is that the adult victim of a rape is given more sympathy than a underage child sexually exploited by an adult. The only other victim given such disdain is a hooker.
What other profession can you think of that is given the benefit of such doubt? Not a priest. Not a policeman.

What other crimes so penalizes the accuser from the outset, just for being a victim?

PRE-TRIAL CONFERENCE Jan 10, 2008 - Stephen Charles Hume, 60, appeared for a pre-trial conference. His attorney reports they are close to a plea agreement. He asked the court for 3-4 weeks to consider the offer.
The charges stem from incidents at Thatcher High School in which students of his discovered he was secretly videotaping them as they changed clothes for art projects last October.
Another conference is scheduled for Feb 4. His trial is set for March 19-21 if no agreement is reached. Posters at the news story of a rumor of a plea agreement that guaranteed no jail time were not so supportive.

TENTATIVE AGREEMENT Feb 7 -Hume "tentatively accepted the terms of a plea agreement from the state" that his attorney said stipulates Hume must plead guilty to one count for each of his six victims. Official plea meeting is Feb 19.

Sentencing will be up to Judge R. Douglas Holt who said he welcomes letters from victims as well as letters in support of Hume and will read them before passing sentence.

GUILTY PLEA Feb 24 - Hume pleaded guilty to six counts of attempted voyeurism, one count for each victim. Judge R. Douglas Holt questioned prosecutors about the plea agreement.
Hold first questioned if there were any memory cards that could have images or video Hume captured while filming students changing clothes for art projects.

Deputy County Attorney C. Alan Perkins said part of the reason the state was going after Hume on attempted voyeurism charges only was that there was only one memory card, which was destroyed during the course of the investigation.

According to Thatcher Police reports, when police first approached Hume at the high school, he was allowed to retrieve the camera from his truck and give it to them before following officers to the police station. In a subsequent interview, Hume admitted to police he had taken the memory card out before handing the camera over and had bent it and thrown it out the window while driving to the police station. Officers later found parts of the destroyed memory card, and information could not be retrieved.
He also questioned a part of the plea agreement that said the state would not pursue any other charges relating to incidents that occurred while he was a teacher at Thatcher High School.

The judge says he plans to sentence Hume to no more than one year in jail - not prison - and three years' probation. Holt agreed there is a legal and technical possibility that, because Hume is pleading guilty to multiple counts that carry a year each, a court could sentence him to serve the counts consecutively. He said, however, that he would only send him to jail on one count.
“I’ve never stacked concurrent terms as consecutive terms in jail in the last nine years, and I don’t suspect I’ll start with Mr. Hume,” he said.
Holt said he will defer accepting the guilty plea until sentencing or the preparation of a pre-sentence report. He set Hume’s sentencing date for Monday, May 5.

tt - So, not only should you write often to the judge, but if you plan to be a voyeur and take perverted pictures, make sure there is more than one victim. And it helps to have a judge with egomania and an underdeveloped sense of justice for the victims.

Shameful

Poster comments found at a news story someone sent us.

Children that age rarely lie about such things. On the other hand, I wouldn't want any of my children or grandchildren taught by a kindergarten teacher who seems to have such a poor understanding of child protection.
And,
Ignorant people like this is why sexual abuse of children is still a high crime in this country. It is true that these predators prey on ones that already have low self esteem and either no family or a problem family where reporting to anyone is difficult. How can this woman teach children and not feel that these stories even if she felt they were fantasies not be grossed out by them. She should be prosecuted for not speaking up about it.
And,
Wow, to think that a kindergarten teacher would dismiss a man's detailed encounters with children as a fantasy is just sick. This teacher should be fired from her job. Can you imagine if a young child made an out cry to this teacher? What would she do? Dismiss the child as a liar? To think that his wife sits there and listens to this testimony, makes me sick to my stomach.
They were responding to a kindergarten teacher who testified for the defense at the trial of a 65-year-old church deacon accused of molesting two girls, ages 6 and 7.

From the story:
[R], a church member, testified for the defense that one of the young girls was often dishonest and that she sat near Livingston at the movie that day and saw no inappropriate behavior.

Prosecutor Anna Jimenez then showed [R], a kindergarten teacher, some of the journals found on Livingston's computer that detailed encounters with the young girls, which [R] dismissed as fantasy
.

BACKGROUND
Livingston was arrested in June 2007 after a mother complained to police that he had molested her daughter. Police found several hundred child pornography images on his computer and, according to police, those pornographic photos were of local children - taken with Livingston's own camera.
"What he was doing, is he was taking pictures of children down their shirts, or up their shorts or skirts and he also had other images of pornography involving children between the ages of 4, 5 up to 12, some adults as well," Detective Eric Blanchard of the Sinton Police Department said.
The trial continues.
Jan 14 - Livingston testified that the journals were fiction and part of his research. Because he planned to minister to child molesters in prison.
He said he used PhotoShop to add in body parts of young girls on several images found in his computers because he was practicing using the software and didn’t think it was child pornography.

Prosecutor Anna Jimenez questioned why Livingston deleted the journals and pointed out details in the entries matched the accusations made by several young girls.
Jan 14 - KRIST tv has been following the trial. There was this bizarre dialogue on Monday between the prosecutor and Livingston.
Prosecutor Anna Jimenez: "Did you take this picture?"
Livingston: "Yeah, I think I did."
Jimenez: "Why did you take this picture of [child's name omitted] with her little tiny areola showing? Why did you do that?"
Livingston: "I don't know. It's not much of a trophy is it?"
Livingston admitted taking pictures of girls by peeping down their blouses, but he said he did not know why he did it.

Investigators were able to retrieve his journal and asked him to read entries.
He read a series of entries:
"Put my hands inside the legs and stroked the tops of insides of her thighs and groin."
"Moved inside the panty line and on top of the shorts."
"Came through the legs of the shorts and did the same thing."
He says he was preparing for a ministry. "I found those as disgusting as you did," he said.

The judge chastised the defense lawyer after the prosecution protested a defense witness who had been called to court by a subpoena issued and served by Livingston. By law, one must receive a subpoena from an officer of the law. The judge called the lawyer into his chambers.

GUILTY VERDICT Jan 16 - After two-and-a-half hours, the jury convicted Livingston one count of aggravated sexual assault of a child and one count of indecency with a child. Jurors began the sentencing phase of his trial. Livingston took the stand, saying he did not want to go to prison and believed he could be rehabilitated through counseling.

Houston Chronicle: Livingston has also been indicted on three counts of indecency with a child in San Patricio County.

SENTENCED Jan 17 - A jury sentenced Livingston to 37 years. They decided on 25 years in prison and a $10,000 fine for aggravated sexual assault of a child and 12 years in prison and another $10,000 fine for indecency with a child. The prison terms will be served consecutively. The judge ordered the sentence.

Livingston's wife said she would continue to support him.

Aberdeen, NEW JERSEY

Indicted for failing to register as a sex offender.

Oct 12, 2007 -
Robert B. Johnson, 41, a teacher at a private school in Aberdeen, was indicted on two counts of violating the requirements of community supervision for life, under Megan's Law pertaining to sexual offenders.

Sentenced in 2004 to four years for endangering the welfare of a child, he failed to register after his release and failed to get approval for his living arrangements. He pleaded guilty to that offense on June 9, 2004, in the midst of his trial on that charge and a charge of possessing child pornography.

Dec 11, 2006 - Barry Ostrander, 43, a Braham High School teacher, was originally arrested in July 2006 when investigators learned of a video taping system had allegedly installed in the bathroom of his home.

It was discovered by Ostrander's wife was changing channels on a television in their bedroom and discovered a live feed from the bathroom camera. The couple's teenage daughter and a friend helped locate the camera behind a floral arrangement, and then that friend and her mother notified authorities.

Federal authories discovered 1,000 electronic images and a dozen video files and indicted him Dec 5th in Federal court on charges of possessing and receiving child pornography. In December, local authorities dropped local charges rather than jeopardize a conviction on the more serious charges in U.S. District Court.

GUILTY PLEA: Feb 27, 2007 - Ostrander pleaded guilty federal charges that he knowingly and intentionally possessed approximately 1,000 electronic images and at least 12 digital video files of minors engaging in explicit sexual conduct.

He also admitted to installing a hidden camera in the bathroom of his Braham residence and taping four minor girls as they dressed and showered. None of those images figured in the pornographic image charges but rather were charged out in Isanti County as felony interference with the privacy of a minor.

A pre-sentencing investigation will be conducted before sentencing. He was dismissed from his job Jul 31, 2006.

SENTENCED: Sept 12 - Ostrander was sentenced to 15 years in federal prison, under a program specifically geared for sex offenders. He will, apparently, be required to pay restitution to the victims and their families to be determined.

July 18, 2007 - Christopher Lucero, 24, a 6th grade teacher at Lavaland Elementary School last year, was arrested and charged with four counts of felony voyeurism after being accused of using a video camera to shoot up the skirts of young girls at an amusement park.

Under the state's voyeurism law, it's illegal to take pictures up a skirt showing a person's undergarments. Lucero is charged with a fourth-degree felony because the case involves a child.

Police spokesman John Walsh said Lucero had a camera attached to his shoe with a wire running up his pants leg to a recorder in his pocket.

Police reviewed the camera footage and found what they described as inappropriate pictures of four young girls.
