May 22, 2007 - Despite the protests of the teacher and the principal, a student's grade was changed from "F" to "D" so he could graduate with the rest of his class.
The State Education Secretary is investigating the grade change. In the meantime, the district is implementing a new policy, according to the school superinendent.
Superintendent Beth Everitt said she will hear appeals for grade changes, and the grade will be overturned only if she approves it and a representative from the Albuquerque Federation of Teachers agrees.TT - That seems like progress. Kinda. Maybe.

INVESTIGATORS CONCLUDE June 21 - State investigators have concluded that Elsy Fierro used undue influence and may have violated the school code of ethics when she ordered the grade change.
However, Fierro today said she and two associate superintendents made the decision to change the grade because the school didn't do enough to notify the parents their son was failing.Fierro's actions have been referred for review by the Educator Ethics Bureau.
CASE DISMISSED Jan 25, 2008 - ThePublic Education Department announced last week it would ask a hearing officer to dismiss the action against Fierro. When the hearing officer said the decision would be up to Education Secretary Veronica Garcia, she took herself off the case, sending it to Children, Youth and Families Secretary Dorian Dodson, who dismissed the case.
The education agency said it could not pursue the matter after two court orders barred evidence of a grade change and intervention by the school district. The judge ruled that using the student’s records in the hearing would infringe on the teen’s privacy, and would bring too much attention to him. (District Judge Nan Nash said the state can use witnesses, not the student's records, to present its case against her.)
