In imposing the prosecutor's recommended open-ended sentence of five years to life, Judge Douglas McBroom said that he believed Laurence E. 'Shayne' Hill, 55, took advantage of his authority numerous times over many years and that the need for punishment outweighed that of rehabilitation in this case.

ALL CHARGES DISMISSED

ARRESTED Oct 13, 2006 - Lance Weinbrenner, 40, A Chaparral Middle School eighth-grade math teacher, was arrested and charged with criminal sexual contact with a 15-year-old boy. See ABC Ch 7 news. NBC Ch 9 Police investigator commends victim for coming forward and urges parents to talk to their children. Contact number given. (Responsible journalism.)

INDICTED Jan 31, 2007 - Weinbrenner was indicted. He faces three counts of criminal sexual contact of a minor, fourth-degree felonies. Originally on paid leave, he resigned on Dec 22.

START OF TRIAL Jan 29, 2008 - Trial scheduled to begin today.

According to court records, the boy's mother called police when she learned Weinbrenner had allegedly touched him. The boy told investigators Weinbrenner would make him sleep in his underwear and on top of him while on camping trips. During one incident the boy allegedly awoke to find Weinbrenner touching him over his underwear.
The trial is expected to conclude Thursday.

END OF TRIAL - CHARGES DISMISSED Feb 1 - Two counts against Weinbrenner were dismissed Thursday on a directed verdict by 12th Judicial District Judge Frank Wilson of Alamogordo. The third and final charge was dismissed Friday morning by prosecutors after Wilson declined to reconsider his earlier ruling and after prosecutors conferred with the alleged victim's family.
[District Attorney Susana] Martinez said the judge believed a charge of criminal sexual contact by a person in a position of authority was more appropriate given the evidence presented.

"The judge dismissed the first two counts because he decided that the charges that existed right now are not part and parcel of a greater charge and he thought there was enough evidence for the greater charge," Martinez said. She called it an "adverse ruling that has never been made in this district" and is contrary to cases "presented here and in the (state) Court of Appeals."
Martinez said Wilson's decision cannot be appealed. District judges in Las Cruces recused themselves from hearing the case because Weinbrenner's father, Neil, is a local attorney.

Spanishburg, WEST VIRGINIA

GUILTY Oct 6, 2006 - Timothy Colbird, a Mercer County teacher in Spanishburg, was found guilty in July of 38 counts in connection with sexual abuse and assault of a 14-year-old male student.

DEATH Coldbird was transferred to a hospital and later died of metastasized cancer and profuse advanced heart disease on Thursday, Nov. 16, 2006. He was 51 years old.

APPEAL Oct 5, 2007 - Lawyers for Colbird's estate asked a judge to set aside Coldbird's conviction, citing the fact that he was not sentenced and death precluded any chance of him appealing the conviction. Mercer Circuit Judge John Frazier declined to set aside Colbird's conviction and told the defense to go ask the state Supreme Court.

State Supreme Court justices will decide Oct. 11 whether to consider Colbird's appeal.

He was the state's "Teacher of the Year" at one point. He also was listed in the "Who's Who in American Universities and Colleges" by the Who's Who Among Students group. Colbird also was named an "Outstanding Young Man of America," according to his obituary.
Clifford said the late Colbird's appeal is necessary for a few reasons; one being the family's right to clear his name.

Two of Colbird's accusers have pending civil suits against his estate. Clifford said he thinks the cases would be tried early next year.

October 2006 -- In a case that illustrates the difficulty of prosecuting sexual abuse charges, Samantha Drash, a Pace High School teacher, is accused of having an inappropriate relationship with a male student.

On Aug. 24, Villalobos had said if an agreement could not be reached with Drash and her attorney within two weeks, the case would go before a jury.

As of Monday, no agreement had been reached and no trial date had been set.
Villalobos said there is not timetable when it comes to justice.

“Because of the difficulties with the parents and the victim we are still trying to get some concessions from the defendant,” Villalobos said.

The concessions include Drash giving up her teaching certificate and removing herself from coming into contact with young boys.
She was scheduled to go to trial in May, but the family at that time and today is refusing to cooperate with authorities.

Teacher Problems

FEMALE TEACHERS - MALE STUDENTS    FoxNews, Feb 12, 2005 - investigative report on "When Ms. Teacher Goes After Male Pupil" -- a look at female teachers in the news for having sex with their students.

THE PROBLEM     A 2004 report on Educator Sexual Misconduct prepared for the U.S. Department of Education is available online.    It's a pedantic and flawed report that consistently confuses "sexual abuse" with "sexual misconduct," the latter a term used by the Ontario Canada Teacher's association.

Nevertheless, the report is disturbing.

Because most educator abusers seek to conceal their sexual contact with students, offenders often target students that they can control.  In some cases, control is characterized by force.  However, most abuse occurs within the much subtler framework of grooming and enticement.  While almost all children respond to positive attention from an educator, students who are estranged from their parents, who are unsure of themselves, who are engaged in risky behavior or whose parents are engaged in such behavior are often targeted, not only because they might be responsive but also because they are more likely to maintain silence. (Robins, 2000; shakeshaft and Cohan, 1994)
Even children with disabilities are targeted. (See Table 14)   As for consequences?  Section 10.1 - notes that in an early study of 225 cases of sexual abuse in New York, all had admitted to sexual abuse of a student, none were reported and only 1% lost their license.  Nearly 39% chose to leave the district, most with positive recommendations and even retirement packages intact.  Many teachers trade an agreement to resign for a positive resignation.

Appendix I consists of 19 pages of news stories about teachers. (pgs 61 to 80)   It doesn't begin to address the problem known in educational circles as "passing the trash" - knowingly moving teachers on when repeat offenders called "mobile molesters" are abetted by school officials who let them move on when allegations arise.  (Edweek.org, Dec 9, 1998. Google cache)  The American School Board Journal calls it "A Trust Betrayed" (June 2002: Vol 189, No. 6)   And the problem isn't new.  It is just generally ignored as a MSM issue.

Post-Gazette Oct 31, 1999 Dirty Secrets: Why sexually abused teachers aren't stopped is a three-part series.
